The person who issued the check, who claims that the check was taken out of his possession against his will, may apply to the Commercial Court of First Instance at the place of payment and request that the addressee bank be prevented from paying the check. This is a preventive measure that is useful to take before canceling the check.<\/p>\n<p>In its decision prohibiting payment, the court allows the addressee to deposit the check amount and indicates the place of deposit. The payment ban is given by the addressee bank. If the person who received the check is known, the court gives the petitioner appropriate time to file a refund lawsuit to get the check back from that person.
